Terms of Service

Operator: Fulcrum Search Services LLC ("SkimHire," "we," "us," "our")

1. Service Overview

SkimHire operates a marketplace connecting pool service companies ("Employers") with pool technician candidates ("Candidates") who have not opted out of being listed. We source Candidates from job boards and direct applications, conduct a structured intake interview, and create a profile after notifying the Candidate of how the marketplace works and how to opt out. Candidates' identifying contact information (name, phone, email) is concealed on the profile until an Employer purchases an unlock credit. "Pre-screened" and "interview screened" as used on our marketplace refer to the structured intake interview we conduct via SMS or email. We do not run criminal background checks, credit checks, or formal employment-history verification.

2. Account Registration

You must create an Employer account to purchase credits and unlock Candidate contact information. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration. Accounts are for your business's hiring use; you may not share account credentials or allow third parties (including staffing firms or resellers) to use your account on your behalf without our written authorization.

3. Credits and Payments

  • Credits are purchased through our Shopify-powered checkout.
  • Each credit unlocks one Candidate's contact information.
  • Credits do not expire.
  • Credit pricing is displayed at the time of purchase. We may adjust pricing at any time; credits you have already purchased are honored at the price paid.
  • All sales are final except as covered by our Satisfaction Guarantee in §5 and our Refund Policy.

4. Candidate Information

  • Candidate profiles display skills, experience, general service area, availability, and pay-rate expectations. Identifying contact information (name, phone, email) is concealed until an Employer purchases an unlock credit.
  • While a Candidate is listed on the marketplace, their contact information may be sold to any number of Employers — there is no fixed cap on how many Employers may unlock a given Candidate. Unlocking does not grant exclusivity; other Employers may unlock the same Candidate while they remain listed.
  • A Candidate remains listed only while they stay engaged with the marketplace. We periodically contact listed Candidates to confirm they are still seeking work; a Candidate who stops responding to these check-ins, or who pauses or opts out, is removed from the marketplace. A removed Candidate is returned to the marketplace if and when they re-engage — for example, by responding to a check-in, updating their profile, or asking to be relisted.
  • Relisting is not guaranteed; it depends on the Candidate's continued consent and engagement, and is never offered to Candidates who have opted out of the marketplace.
  • Candidates may opt out of the marketplace at any time. An opt-out stops future sharing; Employers who unlocked the Candidate's contact information before the opt-out retain what they received.
  • Unlocked contact information is licensed to you for your direct hiring purposes only. You may not resell, redistribute, publish, feed into training datasets, or use the information for any commercial purpose other than evaluating and contacting the Candidate about a specific employment opportunity with your business.
  • We do not guarantee the accuracy of Candidate-provided information. We interview Candidates via SMS or email and record what they tell us; we do not independently verify employment history, credentials, or qualifications.

5. Satisfaction Guarantee

If, within 30 days of unlocking a Candidate's contact information, you discover that:

  • the contact information we provided is incorrect (phone or email does not work),
  • the Candidate is unresponsive after reasonable contact attempts,
  • the Candidate's actual qualifications materially differ from what we represented on the profile, or
  • the Candidate is no longer available for employment,

you may request a credit refund via the refund link on the Candidate's profile page. Refunds are issued as credit restorations, not monetary refunds. The Satisfaction Guarantee does not cover subjective fit, hiring decisions, or outcomes after hire. See our Refund Policy for full details.

6. Prohibited Conduct

You agree, as a condition of using the Service, not to:

  • Use the Service for any unlawful purpose;
  • Attempt to access Candidate information without purchasing credits, or to circumvent the credit or unlock mechanisms;
  • Share your account credentials or allow third parties to use your account;
  • Scrape, crawl, or use automated systems to access any part of the Service;
  • Harass, impersonate, misrepresent yourself to, or retaliate against any Candidate;
  • Contact a Candidate after the Candidate has instructed you to stop or after we have notified you that the Candidate has opted out of the marketplace;
  • Make employment decisions based on a Candidate's race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, age (40 or older), disability, genetic information, or any other characteristic protected by federal, state, or local law;
  • Use information obtained through the Service in advertising, sourcing, or outreach that suggests preference, limitation, specification, or discrimination based on any characteristic protected by federal, state, or local law.

7. Referral Service; No Employment Relationship

SkimHire is a referral service that connects Employers and Candidates. SkimHire does not make hiring decisions, does not set wages or terms of employment, does not guarantee employment outcomes, and is not a party to any employment relationship between an Employer and a Candidate. Any employment relationship arising from the Service is solely between the Employer and the Candidate.

8. Limitation of Liability

To the fullest extent permitted by law, our liability arising out of or relating to the Service is limited to the total dollar value of credits you have purchased in the six (6) months preceding the event giving rise to the claim. We are not liable for any hiring decisions, employment relationships, or indirect, incidental, consequential, or punitive damages resulting from use of the Service.

9. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by email to registered Employers and posted at this URL; continued use of the Service after the effective date of the change constitutes acceptance.

10. Governing Law and Dispute Resolution

Governing Law. These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

Binding Arbitration. Except as carved out below, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or the relationship between you and SkimHire ("Disputes") will be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules then in effect, and not in court. The arbitration will be conducted by a single arbitrator. The seat of the arbitration will be Temecula, California; hearings may be held in Temecula, by video or telephone, or at another location the parties mutually agree on. Judgment on the arbitrator's award may be entered in any court with jurisdiction.

Class Action Waiver. You and SkimHire agree that Disputes will be arbitrated only on an individual basis. Class, collective, consolidated, and representative actions are not permitted. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and decided in court; the remainder of this §10 continues to apply.

Jury Trial Waiver. You and SkimHire each waive the right to a jury trial for any Dispute subject to arbitration.

Carve-Outs. Either party may (a) bring an individual action in small claims court for a Dispute within that court's jurisdictional limits, or (b) seek injunctive or other equitable relief in court for misappropriation of confidential information, violation of §4 (use of unlocked Candidate information) or §6 (Prohibited Conduct), or infringement of intellectual property, without waiving the right to arbitrate other Disputes. Exclusive venue for any such court action lies in the state or federal courts serving Riverside County, California.

Fees and Costs. Each party pays its own fees and costs in arbitration except as AAA Commercial Rules otherwise require.

Notice to SkimHire. Any notice required or permitted under this §10 — including a demand for arbitration, a notice of breach, or service of process — must be sent in writing to:
